To qualify for summary dissolution, you and your spouse must meet all of the following conditions:

  • You have been married or in a domestic partnership for less than five years. 
  • You have no children together born or adopted before or during the marriage (except for pets). 
  • You do not own or lease any real estate.  
  • You have less than $53,000 in community property (assets acquired during the marriage). • You have less than $53,000 in separate property (assets acquired before the marriage or after separation). 
  • Neither spouse has more than $7,000 in debts accumulated since the date of marriage. 
  • Both agree to waive any rights to spousal support. 
  • Both agree on the division of property and debts.
